First day of the terror-trial at the female section of Koridallos prisons, with the three separate cases and 19 accused. The nine imprisoned comrades members of the CCF and T.Mavropoulos, who appeared today left the court room immediately after Olga Economidou read out a statement by the organization.

The statement:

“Before your court-martial begins, I would like to make a statement by the members of the CCF. We are hostages of the greek state and we clarify that we do not recognize any authority, let alone the juridical and of course none of your laws. The fact that we are hostages of war does not mean we have surrendered, that we have regretted.

We remain proud for our organization. Each action of the conspiracy, every word we wrote in our communiques is and will remain an unrepentant part of each one of us. The CCF is the path of the new urban guerilla, it is a part of a widened global conspiracy against the constitutions and the ethics of society which enslaves the human for centuries now.

Our captivity does not intercept the purpose, it does not intercept the new urban guerilla which is being transformed into action on a daily basis, finally it will never intercept our unstoppable struggle for freedom and you puppets of the system are incapable of stopping it.

The CCF is us 9 who have taken the responsibility and none of the other accused have anything to do with the organization and couldn’t. We continue to walk forward together with our comrade Theofilos Mavropoulos in the unstoppable course towards the continuous anarchist insurrection without looking back… we abandon the inhibitions and excuses and we throw ourselves in the fire of action for now and forever.

From here where we stand we send our most warm greetings to the wanted, for participation in the CCF, Dimitris Politis and Giannis Mihailidis. May the fire of the new anarchy forever cover your traces. Until the meeting time at the point of no return. Also we send strength and solidarity to the Italian insurrectionist comrades who are persecuted by the italian authorities as well as to the non-arrested comrades of the Informal Anarchist Federation.

Finally with our thoughts and hearts we are next to anarchist comrade Mario Lopez who was arrested in Mexico injured from the explosion of a home made incendiary mechanism which he was transporting and to anarchist Felicity Ryder who chose the paths of clandestinity and is persecuted for the same case.

Some legal information about the case.

Chairwoman of the terror-court (its official title is Three member felony appeals court) is the president of the appeal judges Maria Tzanakaki and members are Aristidis Baggelatos and Katerina Hondrorizou.

The prosecutor is Sotiris Bagias. In the first case (Pefki and Volos) accused are comrades Giorgos Nikolopoulos, Christos Tsakalos, Damianos Bolano, Giorgos Polidoras, Olga Economidou, Theofilos Mavropoulos, Dimitris Politis, Giannis Mihailidis and Kostas Papadopoulos. D.Politis and Dimitris Mihailidis escaped arrest and did not appear in court.

For the first of the two the case will not be examined because he is of no fixed abode, and the second will be tried in absence because he has a known address.

In the second case (parcel bombs) accused are comrades Christos Tsakalos, Giorgos Nikolopoulos, Damianos Bolano, Giorgos Karagiannidis, Gerasimos Tsakalos, Panagiotis Argirou, Mihalis Nikolopoulos, Alexandros Mitrousias, Giorgos Polidoros, Olga Economidou and Haris Hadjimihelakis.

In the third case (weapons in Nea Smirni) accused are comrades Alexandros Mitrousias, Giorgos Karagiannidis, Kostas Sakkas, Stella Antoniou, Christos Tsakalos, Damiano Bolano, Mihalis and Giorgos Nikolopoulos and Olga Economidou, Christos Politis, Dimitris Michail,  and Giorgos Polidoros                

We have therefore, a total of !9 accused comrades, from which 13 are imprisoned, 4 are free and two are living in clandestinity.

Also, there is a lawsuit by the two cops injured in Pefki (Leontopoulos and Drotsos), only against T.Mavropoulos (for attempted homicide).

There are represented by infamous P.Mantouvalos, together with Kostandinos Pavlou for one cop and Eleni Makinopoulou for the other.

In the morning, the chairwoman although looking clam she had lost complete control of the situation. The room was filled with prosecution witnesses and remained outside not only the dozens of people gathered I solidarity, but even the relatives of the accused comrades. The comrades present stated they will leave in protest, and there was two interruptions until entry was allowed to the amount of people that fit in the room.

During the breaks the 13 comrades (S.Antoniou and K.Papadopoulos are free on condintion, while D.Politis and G.Mihalidis are not there) are transferred to the wing with the new white cells, which was built in the old court room, while at the end of the sessions the men are transferred with a van across to the male section of Koridallos prisons.

When the comrades returned to the court room, the 9 members of the CCF and Th.Mavropoulos remained standing and O. Economidou insisted they read their statement.

The chairwoman tried to stop her, in the name of the rules, but Olga insisted and read it out. After that, the 9 members of the CCF and T.Mavropoulos left the court room. The comrades which remained in the court room were prisoners A.Mitrousias, G.Karagiannidis, K.Sakkas and also S.Antoniou and K.Papadopoulos (C.Politis and D.Michail who are accused of misdemeanors did not appear and will be represented by their advocates).

When later S.Fitrakis gave the statement to be filed in the mintues, the chairwoman said it will filed where in the legal sequence it suppose to be in. the advocate replied “forget the legal sequence, the accused are revolutionaries, they read their statement and it will be filed in the minutes at the time they read it”.

Then the chairwoman announced the names of the accused and their advocates who are: for G. and M. Nikolopoulos and P.Argirou is Fragiskos Ragousis.

For T.Mavropoulos is Ioannis Fotopoulos.

For K.Papadopoulos is Th.Mantas.

For G.Karagiannidis is D.Katsaris. For A.Mitrousias is Annie Paparousou.

For Haris Hadjimihelakis is Sp.Fitrakis.

For K.Sakkas is Marina Daliani.

For S.Antoniou is Ch. Ladis.

For absent Ch.Politis is Kostas Daltas.

And for absent D.Mihail is Ch.Ladis.

Five members of the CCF (C. and G. Tsakalos, Damiano Bolano, Giorgos Polidoros, Olga Economidou) had left the court room and did not approve any advocate to represent them. The court appointed two lawyers each and two lawyers to replace any advocate who couldn’t show up. Of the 130 prosecution witnesses, many were absent (mainly foreign nationals from the parcel bomb case). The prosecutor proposed that their mandatory presence is required and each of them will be fined 100 euro, but the court reserved the decision for a future session, because some might appear still.

The next session is scheduled for Wednesday October 10th at 9am.

New CCF trial, together with other cases, Session 2, Wednesday 10/10/2012

Of the 12 lawyers summoned to be appointed (two for each accused of the five comrades and two substitutes) only half appeared. And while there was no problem of acceptance by the members of the CCF, the prosecutor proposed to not call other lawyers, but the ones present should take on two-three each!.

The chairwoman expressed the same reflection, claiming it is difficult to find lawyers. Which means, although the court decided in the first session to appoint two lawyers for each accused, we have gotten to the point of appointing two lawyers for every two-three accused. The present lawyers reacted, and warned that if such a decision is taken they will have to resign.

Thus, the trial was interrupted, they called more lawyers and with the number of lawyers completed they went onto the appointing, after the newly arrived visited the accused comrades (they had left the room of the terror court) and had received their acceptance.

Proud member of the C.C.F.  Mihalis Nikolopoulos made the following statement:

 “Today begins one more political court martial. Lets be clear. No worm of the juridical mafia, as these here, are worthy to judge an attack or a member of our organization. For us all those are on the opposite side and we are at war with them. Our attitude towards them is no other, than hostile and aggressive, as a token of our real intentions. Because with the modern inquisitors of the juridical mafia, every fighter of the anarchist guerilla except blowing p their houses and their court rooms, as well as applying the practice of political executions on many of them in the frames of anarchist terrorism.

The direct and frontal clash with any kind of institutional or not form of authority.

As anarchists of praxis, therefore, we fight their Justice, we fight every kind of forms of authority of the social machine.

In this journey our only destination is anarchist revolution.

Our vehicle is every insurrected war cry from inside and outside the walls.

  Proud member of the C.C.F. Panagiotis Argirou made the foloowing statement:

“This is how the situation is. You yourselves, servants of a more sleazy society, which has given you the right to bury human lives, have the audacity to appear here in front of us in order to judge us for our anarchist and aggressive action against the world and the civilization you represent. But from me all you will receive is my untold hatred for your click.

Because yes, I am your enemy and enemy of the system of which you are part, as an anarchist and as a proud member of the CCF and the Informal Anarchist Federation/International Revolutionary Front.

I do not regret anything, for any of my actions, for any of my choices,. I was and will be hostile to any authoritarian and slavery behaviour. Now, trapped in the arrogance given to you by your position, you think you are unaffected and safe. This, of course, as painfully realized by many of your colleagues in different countries from time to time, is not but false feeling of safety and maybe the day will come when you will also realize it with the exact same painful way.

The trial was adjourned till Monday October 22nd, in order for the advocates to take a look at the case.

Theofilos Mavropoulos spoke first today and read out excerpts from a statement by the wanted comrades Giannis Mihailidis and Dimitris Politis, who arwe accused of being members of the CCF:
“Let us speak at the occasion of the trial against the revolutionary organization Conspiracy of Cells of Fire, because we happen to be wanted in this case.
 No, we’re not making any appeal to the judicial representatives of Power. It makes no sense to address our enemies. We appeal to our comrades, in the narrow and broad sense of the word. We want to first clarify that we are not members of the R.O. Conspiracy of Cells of Fire, not to forego any of our legal responsibilities, but to avoid the identification of our political discourse with the organization’s discourse, given that we maintain our disagreements.
Of course, we remain unrepentant for our choice to support and be factually supported by the CCF comrades, and our choice to join actively in the anarchist struggle.
As anarchists, we are hostile to the judicial system and the State in its entirety. Therefore, to us, any state prosecution against us is also a title of honour
WE DO NOT RETREAT – WE DO NOT SURRENDER
We stand in solidarity with our comrades of the R.O. Conspiracy of Cells of Fire, our comrade Theofilos Mavropoulos, the anarchist revolutionaries accused in the same case, and all unrepentant prisoners of the revolutionary war.”
Then spoke Christos Tsakalos, who started by saying “So, because our words are actions, we do not intend to resort to a cowardly rhetoric of innocence. Legitimacy for us is the treaty of the slaves. The law is a prostitute which pimps itself out for the interest of authority.
And all you judges and “honourable” prosecutors are the pimps which escort it to its clients. It is true we broke your laws. It is true that we will act the same again and again. You judge in the name of the law, we act in the name of dignity and anarchist conscience. Between us there is a gap which does not fit neither legal kindness, nor pretentious dialogues”. And he concluded, : “One thing therefore you can be sure of. We will not give you even a second of peace”.
The chairwoman of the terror-court Maria Tzanakaki, in her attempt to make the advocates to shorten the necessary time of the trial break, made the mistake of publicizing her verdict on the innocence or not of the accused. Addressing their advocates she reminded them that the accused are temporarily imprisoned and that there is also the matter of the 18month pre-sentence detainment period.
This means that the accused should not be released after the 18 month period finishes. Prosecutor Bagias was asked that the trial is adjourned after 10am, he answered that this cannot take place because the accused are temporarily imprisoned! Finally, the prosecutor proposed a week adjournment and the terror-court accepted his proposal. Thus, the trial will continue on Monday October 29th.

 

Announcement by Christos Tsakalos (member of the CCF) before the beginning of the 3rd session on 22/10/2012

So, because our words are actions, we do not intend to resort to a cowardly rhetoric of innocence. Legitimacy for us is the treaty of the slaves.The law is a prostitute which pimps itself out for the interest of authority. And all you judges and “honourable” prosecutors are the pimps which escort it to its clients. It is true we broke your laws.
It is true that we will act the same again and again. You judge in the name of the law, we act in the name of dignity and anarchist conscience. Between us there is a gap which does not fit neither legal kindness, nor pretentious dialogues. Our intention is for this trial to become the reason for more anarchist attacks internationally.
We are not here to be tried and reverently bow our heads to your “sacred” laws. On the contrary we are here to provoke with our impiety towards every authority and abolish the fear of oppression. Thus we send a signal to our comrades. When inside you don’t regret your decisions, then no authority can beat you.
I will in no way use the orthodox revolutionary rhetoric by speaking about our noble motives and the oppressed people. No, our anarchist insurrection is clearly a personal existential case of each one of us, and not a literature report with selflessness and politeness inside a court room. We do not represent anyone except ourselves. We are anarchists-individualists and nihilists and we believe in the will power of the individual.
We are comrades with those who turn their words into fire, rocks, bullets and we despise the society which fatally bows the head to authority, tolerates the fascists and hides in its fears and illusions.
Freedom is not begged for, it is conquered.
We are victimizers and not victims.
We are the hunted who hunt the hunters.
We have a dream which we transform into thought.
We have a thought which we transform into action.
We have an action which we transform into attack, even if this is our last breath.
It is the breath which is heard by every anarchist urban guerilla and is transformed into a chant at a demonstration, into fire, into a wick, into a detonator, into an explosion.
It is our voice which was united with the voices of the 300 comrades who on Friday night carried out a solidarity demonstration to the Conspiracy Cells of Fire in the centre of Athens and Exarhia, disturbing with their passion the social cemetery of the metropolis.
It is our rage which becomes gasoline in the hands of the comrades who the last few weeks have been torching and smashing trams, atms, banks, government vehicles, post offices, pawn shops, expressing their solidarity to us.
One thing therefore you can be sure of. We will not give you even a second of peace. At the same time we would like to send our warmest greetings to the New C.C.F.- Groups for the Spreading of Terror, the Informal Anarchist Federation (FAI) and to all the anarchists of praxis.

 New C.C.F. trial, Session 4, Monday 29/10/12

This session also began with the announcement of the names of the accused comrades and their advocates by the chairwoman of the terror-court M.Tzanakaki. Absent were comrades G.Tsakalos, C.Tsakalos, Olga Economidou, G.Polidoras and H.Hadjimihelakis, present were comrades G.Nikolopoulos, M.Nikolopoulos, P.Argirou, D.Bolano, Th.Mavropoulos, K.Papadopoulos, A.Mitrousias, G.Karagiannidis, K.Sakkas and S.Antoniou.
However, were also absent the advocates of the first three present comrades and of D.Bolano who was absent. The court was informed that D.Bolano will not accept to be represented by another advocate and that the two appointed advocates will arrive at 10.30.
Thus, the court was interrupted and re-started the session with a discussion about the formal admissibility of the civic prosecution statement. The advocate of T.Mavropoulos, G.Fotopoulos, extensively argued his disagreement concerning the formally admissible statement by the prosecution. Specifically, he claimed that the statement suffers of vagueness and cannot be completed afterwards. On the other hand, prosecutor S.Bagias had the opinion, that by law the statement of the prosecution has all the elements to be considered formally acceptable.
The terror-court decided to accept the civic prosecution statement. Afterwards, the prosecutor read the summaries of the three referral indictments. At this point, advocate Fr.Ragousis informed the chairwoman, that the advocates of G.Tsakalos are absent and he does not accept to be represented by anyone else. The chairwoman interrupted the session for ten minutes while saying: “Lets get a move on though, we are tired and we are not getting any work done.
We are not saying we like to work, but in any case… ”. After the short break, we came into the ‘main course’ of the session, which was when the prosecutor read out the summaries of the three referral indictments. Defence advocate S.Fitrakis pointed out to the prosecutor and the court, that after the reading of the summaries there should be an analytical reading of the enacting ordinances of the three referral indictments by the secretariat of the court.
However, after the completion of the reading of the summaries of the indictment by the prosecutor, the chairwoman called for those of the accused who are present to state if they have something to say concerning the indictments, something which was obviously going to cause the immediate reaction of all defence advocates. F.Ragousis demanded for article 171 par. D of the code of criminal procedure to be applied, not in the form of absolute invalidity, but for the better information of the accused and the defence of their rights. As he characteristically said,: “we are not saying that the court is breaking the law by not reading out the enacting ordinances of the referral indictments”, but the demand is made and is not connected with the invalidity.
S.Fitrakis said he heard his colleagues opinion, but considers that there is an absolute invalidity of the procedure, when the accused ask for the enacting ordinances of the referral indictments to be read and the court refuses to read them. He concluded by saying: “If you accept the oppressive model, you will refuse them the read. But if you accept an in between model, then I tell you to read the indictments”. The other advocates, except A.Paparousou, stated that they agree with the application by F.Ragousis.
The terror-court accepted the demand to read the referral indictments, which will take place tomorrow Tuesday (Oct. 30th).

This session lasted about 4 hours and was limited to the reading of the enacting ordinances of the referral indictments. This had been proposed by the defence advocates who could not appear in the session, sothe trial could not have continued without their presence.
During the reading of the ordination of the referral indictment number 208, it was realized that the advocates had not got page 209 which concerns the Chilean embassy. There was some tension and advocate F.Ragousis objected, according to article 173 of the code of criminal procedure, asking for the specific page to not be read and not be taken into consideration.
The terror-court, after the proposition of the prosecutor, rejected the first part of the objection, which was to not read the page, and reserved the right to decide about the second part.
The trial will continue on Monday 5/11/2012 at 10am. and it will begin with statements of the accused comrades concerning the indictments. It is a standard practice in all courts (not just the terror-courts).

This session was very short, given that all Lawyer Associations have called for a five-day abstention and, the advocates, through S.Fitrakis, announced that they are absenting from this session.
Because two advocates, A.Paparousou and F.Ragousis (through a representative), stated that they have problems with the dates of next session, Paparousou for Monday 12th November and Ragousis for Wednesday 14th November, the chairwoman of the terror-court M.Tzanakaki, who every time the next date is discussed she expresses her stress that tie is going by and there is no progress in the trial, was intended for Friday November 16th, after throwing her “threat”, that maybe later the terror-court will have to have sessions every day.
Then intervened the prosecutor S.Bagias to say that “that is too far” and proposed Monday the 12th, which the chairwoman agreed on.

Before the session began, Gerasimos Tsakalos read out the following announcement of theConspiracy Cells of Fire:
“Because silence is not gold and often it carries with it confusion, we want to clarify something as anarchist urban guerillas who participate in the Conspiracy Cells of Fire. We do not intend to speak or excuse our actions to marionettes of the system which hide their cowardliness behind their juridical axiom.
You judge in the name of the law and we act in the name of our anarchist conscience. You chose as your truth a society whose memorials are prisons, banks police stations, ministries and courts and we a world of dignity, free conscience, anarchist insurrection and genuine meanings and desires.
There are no margins for comparison, or dialogue. There is only the armed clash between the inquisitors and courtiers of the existing society and its deniers. Just like Prometheas, we steal the fire of your empire and with audacity and impudence we unleash it against you so it can torch all the idols of authority you represent. We will not act in your little play neither do we fit in your legal frames.
The pages of your indictment seem very small to fit the and describe the size of the attack we want to unleash against the regime of democracy and the society of its subjugated. Keep plenty of pages empty in the indictments and charges because the struggle has not finished, neither will we as a Conspiracy ever surrender our weapons. There are still desires which were not imprisoned, eyes which did not fear the enemy, mouths which did not speak the language of compromise, heads which did not bow towards the empire of authority…
No sentence and no prison will make us change our choice. The choice of constant attack remains until the end… As for our presence in court, we refuse to appear as disciplined and subdued accused who await the decision of their judges.
We don’t care what you say and we cannot even see you… Because however in this trial, other people are accused who had, and neither could have had any relation with the C.C.F., in every session some comrades of us will be here to interrupt the slightest possibility of confusion which could be created…
This is why, at this point we stress to all, friends and enemies, lawyers and accusers, to limit themselves to the legal sector which is attributed to them and there should be no reference to the C.C.F. The only people who can speak about the C.C.F. are us and the anarchists of praxis who have felt the breathe of the insurrected fire warming their covered faces, as they walk against their time, against the path of the mass…

Immediately after comrade Theofilos Mavropoulos made the following statement:
“All decisions, when about freedom, close death inside them. We, through this death must win life. A deep breath for the journey with no end
In Pefki there was an armed clash between two anarchists and the forces of the police.
Its two dogs, Leontopoulos and Drosos tried to arrest me and my comrade. Our answer was the refusal of surrender through armed resistance aiming at retaining our freedom, which we highly appreciate as anarchists.
The result is known, my comrade escaped by stealing the cop car and I was arrested while injured. Together with me were injured both cops which I shot first managing to surprise them. No doubt, if the cops died and me and my comrade were unharmed, we would have left.
Irrelevantly from the fact that my operational priority was disengagement and escape, it would be my honour if at the same time I had the blood of the two cops on my hands, not only because they tried to arrest me, but simply because they are cops.
Every cop as an immediate carrier of authority, for whatever reason they became a cop, is a live target for an anarchist armed revolutionary. Politicians, mega-journalists and mega-businessmen, snitches, fascists, representatives of the cloth, correctional officers and of course you the judges, as well as every other pillar or lackey of the system, are always in the target of the urban guerillas.
The generalized attack against the existing, of course, becomes more complete when all means are used. Stones and molotov, fly-posting and flyers, slogans, texts, demonstrations and p.a. Sound system gatherings, bombs and bullets.
In the frames of the multiform anarchist action and specifically those of armed struggle, I also had the honour to meet the nihilist urban guerillas of the Anarchist Revolutionary Organization C.C.F. In the houses in Volos and Kallithea, I was not present loosely as a comrade.
I was a factual part of the intriguing against the rotten world of authority. I had consciously made my passage through to revolutionary clandestinity together with other comrades unknown to you, as well as with the wanted brothers Giannis Mihailidis and Dimitris Politis.
Target of each one was to spread anarchy to today at the expense of authoritative society. This target remains a continuous bet even for all those of us who are in prison, since we are unrepentant for our choices and the battles we gave and give as anarchists of praxis.
Because we got sick of the routine, the inhibitions and the cheap way of life they are trying to serve us. Because we got disgusted with the perceptions of subordination, ass kissing, snitching and the hunt for social and economic advancing.
Because we hated every authoritative worm that wants to steal our lives and finally because we wanted to take our lives into our own hands in the here and now and we declared the anarchist war.
Through this war we discover ourselves every day, together with the anarchist thoughts we create and open new prospects of attack.
 We fight against the existing because that’s the only way we exist. The clash at Pefki began as an random identity check and concluded with an, not at all random, battle of free people with the forces of order, anarchy with authority, and more proof that the “almighty enemy” has flesh and bones and is mortal.
It was a battle, a conscious choice for which I am proud and sure that if I could go back in time I would do it again. Besides, the most powerful weapon for a insubordinate anarchist of action is non other than their conscience. For the battles given and that will be given.

After these statements, the members of the C.C.F. and Theofilos Mavropoulos left the room and only two members remained to overlook the procedure, as they just explained in their statement. The procedure began with the chairwoman asking questions and asking the “accused” to make statements concerning the indictment.
The members of the Conspiracy refused to speak, without exercising the right to remain silent, but without recognizing the procedure as they have mentioned in the past. Followed the matter of joint trying the three cases (in this trial the comrades are cited with three different indictments).
All the lawyers were for the demand except for the two people who are accused of misdemeanours irrelevantly to the Conspiracy. The prosecutor agreed on the matter and asked for the two cases of misdemeanours to be cut and brought to a responsible court.
The trial continued with a verbal information of the objections that will follow from the side of the advocates while after that the chairwoman announced the schedule for the next sessions and adjourned until Friday 23/11.
